Terms of Service

1. Company Positioning & Service Scope
UrbanWeb Host Pvt. Ltd. operates as a full-stack digital infrastructure company, providing managed hosting, cloud infrastructure, website development, and related technology services.
Our services include:
- Managed Shared Hosting
- Managed Cloud Hosting
- VPS & Dedicated Servers (Managed / Unmanaged)
- Website Design & Development
- Website Hosting & Deployment
- Basic Email (cPanel Webmail)
- Google Workspace / Microsoft 365 Reselling
- Custom Server Setup & Infrastructure Projects
- SaaS Products (governed under separate terms)
All infrastructure is curated, managed, and optimized by UrbanWeb Host using a combination of global data centers and technology providers.
2. Nature of Services (Managed vs Unmanaged)
- All standard hosting plans are fully managed unless explicitly stated otherwise.
- VPS and Dedicated Servers may be offered as unmanaged services, where the client assumes full responsibility for server configuration, security, and maintenance.
- For managed services, UrbanWeb handles server-level operations but does not control client-side applications.
3. Website Development & Ownership
UrbanWeb Host may design, develop, and deploy websites for clients. Upon full and final payment, ownership of the following transfers to the client:
- Website design
- Code (excluding proprietary tools/frameworks)
- Media assets (unless licensed otherwise)
UrbanWeb Host retains the right to:
- Showcase completed work in its portfolio
- Reuse non-confidential components or frameworks
4. Infrastructure & Service Delivery Model
UrbanWeb Host uses multiple infrastructure providers and reserves the right to:
- Allocate services across data centers
- Migrate servers or environments
- Modify backend configurations
These actions are performed to maintain performance, security, and scalability.
5. Acceptable Use & Resource Policy
Clients must use services lawfully. Strictly prohibited:
- Illegal content hosting
- Phishing, hacking, fraud
- Malware distribution
- Spam or abusive traffic
- Intellectual property violations
Resource Usage:
- CPU, RAM, storage, and bandwidth are governed by plan limits
- Fair Usage Policy (FUP) applies
- Accounts exceeding limits may be auto-restricted or suspended without prior notice
6. Account Responsibility
Clients are fully responsible for:
- Account credentials
- Website/application security
- Activities performed under their account
UrbanWeb Host is not liable for unauthorized access due to weak credentials or client-side vulnerabilities.
7. Billing, Payments & Enforcement
- All services are billed in advance
- Auto-renewal is enabled by default
- 3 days overdue → Service Suspension
- 10 days overdue → Service Termination
- Post-termination → All data permanently deleted
UrbanWeb Host is not responsible for data recovery after termination.
8. Refund Policy
- 100% refund available only within the first 30 days of initial service activation
- Applies to first-time purchase only (including monthly plans)
- Renewals are non-refundable
- No refunds for setup work, custom development, or third-party services
Refund requests must be submitted via support ticket.
9. Backups & Data Responsibility
- UrbanWeb Host may maintain backups for up to 60 days, where applicable
- Backup availability is not guaranteed
- Clients are solely responsible for maintaining independent backups and verifying data integrity
- UrbanWeb Host is not liable for any data loss
10. Email Services
- Basic webmail is provided within hosting plans for limited use
- Google Workspace and Microsoft 365 may be resold
- UrbanWeb Host is not responsible for email deliverability or third-party email service performance
11. Custom Infrastructure & Server Projects
For custom server setups or enterprise services:
- Services are billed per project
- Root access may be granted as required
- UrbanWeb Host is not liable for failures, downtime, or data loss resulting from client changes, third-party configurations, or external integrations
12. Service Availability & Downtime
While high uptime is targeted, UrbanWeb Host does not guarantee uninterrupted service. Downtime may occur due to:
- Infrastructure issues
- Maintenance
- Cyberattacks (e.g., DDoS)
- Third-party failures
No compensation is guaranteed unless defined in a separate SLA.
13. Suspension & Termination Rights
UrbanWeb Host reserves full rights to suspend or terminate services for:
- Non-payment
- Resource abuse
- Security threats
- Abuse complaints
- Policy violations
This may occur without prior notice.
14. Pricing & Plan Modifications
UrbanWeb Host reserves the right to:
- Modify pricing
- Change plan structures
- Update features or limits
Changes may apply at renewal or immediately where required.
15. Limitation of Liability
UrbanWeb Host shall not be liable for:
- Loss of data
- Loss of revenue or business
- Indirect or consequential damages
- Third-party infrastructure failures
Total liability, if applicable, shall not exceed the amount paid by the client for the service.
16. SaaS Products
UrbanWeb Host may offer SaaS platforms (e.g., internal products). All SaaS services are governed under separate Terms of Use, which must be accepted independently.
17. Dispute Resolution & Jurisdiction
- Governed by laws of India
- Jurisdiction: Pune, Maharashtra
- Any dispute shall first be resolved via binding arbitration before proceeding to courts
18. Modifications to Terms
UrbanWeb Host reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
